AI in Publishing, Contracts, and Freelance Work

How publishers, clients, and freelancers are handling AI in contracts and submission rules: disclosure, warranties, verification, and ownership questions.

The short answer

Put AI expectations in writing before work starts: what use is allowed, how it is disclosed, how authorship is verified, and what happens if the rules are broken.

Why contracts need to address AI now

Clients want to know what they are paying for, publishers want to avoid publishing work that breaks their rules, and writers want protection from false accusations. Silence in a contract leaves all three exposed.

Clauses worth considering

  • Permitted uses: none, or specific tasks such as research or editing.
  • Disclosure: how and when any AI use must be disclosed.
  • Representation: the writer states that the work complies with the agreed AI terms.
  • Verification: how authorship may be checked, such as version history or a writing record, and that a detector score alone is not proof of a breach.
  • Remedy: what happens if a breach is shown, such as revision, refund, or termination.
  • Confidentiality: whether client materials may be entered into AI tools.

Submission guidelines for publishers and contests

  • State clearly whether AI-generated or AI-assisted work is accepted.
  • Define AI-assisted, for example whether spell-check or grammar tools count.
  • Explain how compliance may be checked.
  • Describe what happens if a violation is found after acceptance or publication.

Ownership and copyright

In a January 2025 report, the U.S. Copyright Office said copyright requires human authorship. Entering a prompt is not enough to make someone the author of what an AI produces, but human selection, arrangement, and modification of material can be protected, and using AI as a tool does not by itself remove protection from a human author’s work. That makes it more important for publishers and clients to know how a work was made. Rules differ in other countries.
